Women’s & Children’s Hospital Foundation Lottery

1. Key Details

The Women’s & Children’s Hospital Foundation Lottery (Lottery) is being conducted by Women’s & Children’s Hospital Foundation INC (WCH Foundation) ABN: 99682331968. These terms and conditions apply to the conduct of the Lottery. By purchasing a ticket in the Lottery, you agree to be bound by these terms and any other terms attached to specific prizes, including the terms of redemption. The Lottery is conducted in South Australia under Lottery Licence #M14590.

• Ticket sales commence on 16 July 2024.
• Ticket sales close at 11.59 pm (ACST) on 21 October 2024, unless sold out prior.
• A maximum of 11,500 tickets will be sold.
• Tickets are $50 each.
• Total recommended retail value of all prizes is $186,453.42.

The WCH Foundation improves the health and wellbeing of women, children and families under the care of the Women’s and Children’s Health Network. The WCH Foundation relies upon generous contributions from the community to support the purchase of state-of-the-art medical equipment, deliver our Laklinyeri Beach House Program, provide immediate emergency support to families in need, reduce distress and anxiety of patients through our extensive Arts in Health Program, and invest in vital medical research.

2. Prizes

2.1 VIP Prize
The VIP Prize winner will win $5,000 cash. Only tickets purchased before 11:00am on 18 July 2024 are eligible for the VIP Prize. The winner of the VIP Prize will remain eligible to win the Golden Early Bird Prize, Early Bird Prize, the Social Media Competitions and First Prize.

2.2 Golden Early Bird Prize
The Golden Early Bird Prize winner will win Gold Bullion to the value of $10,000. Only tickets purchased before 11:59pm on 12 August 2024 are eligible for the Golden Early Bird Prize. The winner of the Golden Early Bird Prize will remain eligible to win the Early Bird Prize, the Social Media Competitions and First Prize.

2.3 Early Bird Prize
The Early Bird Prize winner will win a $10,000 Phil Hoffmann Travel voucher and $5,000 cash. Only tickets purchased before 11:59pm on 2 September 2024 are eligible for the Early Bird Prize. The winner of the Early Bird Prize will remain eligible to win the Social Media Competitions and First Prize.

2.4 First Prize
The First Prize winner may choose between $150,000 cash; OR a Hilux 4×4 Rogue 2.8L T Diesel Automatic Double Cab which has a recommended retail price of $78,113.42 and a Jayco Journey Touring Caravan 19ft (19.61-3) which has a recommended retail value of $77,590. Tickets purchased before 11:59pm on 21 October 2024 are eligible for a First Prize.

2.5 Other details
(a) All prizes are not transferable, or otherwise substitutable, by the prize winner.
(b) No component of a non-cash prize may be redeemed for cash.
(c) All prizes are subject to availability. If any prize or part of it becomes unavailable due to circumstances beyond the WCH Foundation’s reasonable control, it reserves the right to provide a similar product of equivalent value as the original prize, subject to any applicable laws.
(d) In relation to the non-cash Early Bird Prize option:
• (i)The voucher is valid for 36 months (from date of issue) only. Please contact Phil Hoffmann Travel on 8350 5700 to redeem your voucher. Travel is subject to availability at time of booking. Extensions, alterations, and upgrades are subject to availability and at own expense. The voucher is not transferable or redeemable for cash, traveller’s cheques, foreign currency, or other credit. Voucher only valid on new bookings only. Items of a personal nature, including travel insurance, are not included. Bookings are subject to ‘Phil Hoffmann Travel Bookings Conditions and advisory services apply’. Prize winners will be subject to those terms and conditions and the WCH Foundation accepts no responsibility for compliance with, or enforcement of, those terms and conditions.
• (ii) Upon issue to the prize winner, the vouchers will not be replaced by the Women’s & Children’s Hospital Foundation in any circumstances (including if lost, destroyed or stolen).
(e) In relation to each of the non-cash First Prize options:
• (i) The recommended retail price includes cost of delivery to locations in metropolitan Adelaide, stamp duties, CTP and 12 months registration.
• (ii) The actual vehicle and caravan may vary from the image, which is used for illustrative purposes only.
• (iii) The estimated delivery date is approximately 2-6 months after the prize is claimed (to allow for placement of orders for both Toyota and Jayco), but may be subject to change.
• (iv) For the Toyota Hilux Rogue the prize offered is the Hilux 4×4 Rogue 2.8L T Diesel Automatic Double Cab. For the Jayco Caravan the prize offered is for the Jayco Journey Touring Caravan 19ft (19.61-3). Any upgrades or extras are to be discussed directly with both Jayco Adelaide and CMI Toyota and will be at the cost of the winner.
• (v) Colours, features and options are subject to change for both the Toyota Hilux Rogue and Jayco Journey Touring Caravan 19ft (19.61-3).
(vi) If the winner selects the Toyota Hilux Rogue and Jayco Journey Touring Caravan 19ft (19.61-3) as a prize, they must have, or make arrangements to have, an appropriately licensed driver collect the vehicle from CMI Toyota.
• (vii) If the winner selects the Toyota Hilux Rogue and Jayco Journey Touring Caravan 19ft (19.61-3) it will be the winner’s responsibility to ensure they have appropriate towing gear fitted to a compliant tow vehicle. Delivery will be from Jayco Adelaide premises, and it is the winner‘s cost for any delivery outside of Metro Adelaide, including the winner’s having appropriate insurance cover in place before taking delivery of the prize.

2.6 Social Media Competitions
(a) The Bonus Draw 1 Prize.
The Bonus Draw 1 Prize winner will win a retail voucher to the value of $250.
To be eligible for this prize, ticket holders must:
• (i) have purchased tickets before 11:59pm on 18 September 2024;
• (ii) be following the WCH Foundation Lottery Facebook page before 11:59pm on 18 September 2024; and
• (iii) tag a friend in the comments of the nominated post on the WCH Foundation Facebook page before 11:59pm on 18 September 2024.
The winner of The Bonus Draw 1 Prize will remain eligible to win The Bonus Draw 2 Prize and First Prize.
(b) The Bonus Draw 2 Prize.
There will be 5 winners drawn at random who meet the below criteria for The Bonus Draw 2 Prize. Each winner will win a retail voucher to the value of $100.
To be eligible for these prizes ticket holders must:
• (i) have purchased tickets before 11:59pm on 2 October 2024;
• (ii) be following the WCH Foundation Lottery Facebook page before 11:59pm on 2 October 2024; and
• (iii) tag a friend in the comments of the nominated post on the WCH Foundation Facebook page before 11:59pm on 2 October 2024.
The winners of The Bonus Draw 2 will remain eligible to win the First Prize.

3. Draws

3.1 Time and location of draws
(a) The VIP Prize will be drawn from 10:00am on 19 July 2024.
(b) The Golden Early Bird Prize will be drawn from 10:00am 14 August 2024.
(c) The Early Bird Prize will be drawn from 10:00am on 4 September 2024.
(d) The Bonus Draw 1 Prize will be drawn from 10:00am on 20 September 2024.
(e) The Bonus Draw 2 Prizes will be drawn from 10:00am on 4 October 2024.
(f) The First Prize will be drawn from 10:00am on 23 October 2024.
(g) All draws will occur at the offices of the WCH Foundation: Ground Floor, 55 King William Road, North Adelaide, SA 5006.

3.2 Draw details
(a) All draws will be determined by lot (using random number generator software developed for the purposes of assisting the conduct of lotteries).
(b) All draws will occur:
• (i) under the supervision of the WCH Foundation;
• (ii) in the presence of a scrutineer who is not associated with the WCH Foundation or otherwise involved in the conduct of the lottery; and
• (iii) in the presence of any ticket holders who wish to be present.

3.3 Social Media Competition Draw details
(a) All Social Media Competitions (Bonus Draws 1 and 2) will be determined by lot (using random number generator software developed for the purposes of assisting the conduct of lotteries). The WCH Foundation will then ensure the winner matches all the outlined criteria before winner notification.
• (i) If a winner enters the Social Media Competition but is not eligible to receive the prize, i.e. they don’t have a current ticket or are not following the Lottery on Facebook, then the WCH Foundation will choose another eligible winner.

4. Winner notification and collection of prizes

4.1 Notification
(a) All winners will be contacted via telephone and email from the WCH Foundation within 7 days of each draw with information on how they may collect their prize.
(b) If a prize remains unclaimed for at least two weeks after it is drawn, the WCH Foundation will make additional attempts to contact that winner to ensure they are aware they have won.

4.2 Publication
(a) The prize winner’s name will be published:
• (i) on our Lottery website no later than 24 hours after the prize is drawn;
• (ii) in an Electronic Direct Mail blast to those who purchased a ticket in the Lottery no later than 24 hours after the prize is drawn; and
• (iii) on the Lottery Facebook page and Instagram page no later than 24 hours after the prize is drawn.
(b) Ticket purchasers may request to have their name excluded from publication by contacting [email protected] or calling 1300 001 774.

4.3 Claim
(a) It is the responsibility of the prize winner to claim their prize.
(b) Prizes will be awarded to the first person named on the official ticket. Prize winners may be asked to provide 100 points of identification, as a condition of prize collection occurring.
(c) Each winner will have one calendar month from the final draw date to claim their prize.
(d) If any of the prize winners do not collect their prize during this one calendar-month period, they will be deemed to have forfeited any right to their prize, and in conversation with the Office of Consumer and Business Services, the WCH Foundation will redraw the prize.


4.4 Redraws
(a) If a redraw is needed the redraws will take place at the following times:
• (i) The VIP Prize will be redrawn from 10:00am on 26 August 2024.
• (ii) The Golden Early Bird Prize will be redrawn from 10:00am on 23 September 2024.
• (iii) The Early Bird Prize will be redrawn from 10:00am on 14 October 2024.
• (iv) The Bonus Draw 1 Prize will be redrawn from 10:00am on 28 October 2024.
• (v) The Bonus Draw 2 Prizes will be redrawn from 10:00am on 11 November 2024.
• (vi) The First Prize will be redrawn from 10:00am on 2 December 2024.
• (vii) All redraws will occur at the offices of the WCH Foundation:
Ground Floor, 55 King William Road, North Adelaide, SA 5006 in the presence of a scrutineer.
(b) All redrawn winners will be published:
• (i) on our Lottery website no later than 24 hours after the prize is drawn;
• (ii) in an Electronic Direct Mail blast to those who purchased a ticket in the Lottery no later than 24 hours after the prize is drawn; and
• (iii) on the Lottery Facebook page and Instagram page no later than 24 hours after the prize is drawn.

5.Other matters

5.1 Agreement
(a) This lottery is conducted in South Australia under Major lottery Licence No. #M14590 issued by the Office of Consumer and Business Services.
(b) By entering the lottery, you represent that you have read, understood and agreed to these terms and conditions.

5.2 Eligibility for entry
(a) Entry is open to any individual who is:
• (i) 18 years of age or older; and
• (ii) not an employee, board member, relative (including spouse or de facto spouse, parent, child and sibling), associate or related body corporate of:
• The WCH Foundation; and
• Freerange Future.
• Digital Marketing Tribe.
(b) Ticketing prizes will be awarded to the person named on the official ticket. Only one prize will be awarded to the group of individuals, where more than one person’s name appears on the ticket (by way of illustrative example only and for the avoidance of doubt: if more than one name appeared on the ticket that wins the VIP Prize, a total of $5,000 only will be awarded to the first named person on the ticket).
(c) Multiple ticket purchases will have all numbers printed on one single sheet, being the official ticket.
(d) The WCH Foundation accepts no responsibility for any entries not received for any reason during the lottery period. No responsibility will be taken for lost, late or misdirected entries.
(e) The WCH Foundation is not responsible for unforeseen technical difficulties with the ordering process and does not guarantee the ordering process will always be available.
(f) All requests for refunds will be honoured if the method of payment has been transacted and the corresponding ticket has not been included in any prize draws.

5.3 Personal information
(a) Your personal information will be collected by the WCH Foundation in connection with this lottery and:
• (i) used to administer the lottery, enable the identification of the prize winner and to provide you with marketing, promotional and advertising information about the WCH Foundation; and
(ii) handled in accordance with the WCH Foundation’s privacy policy located here.
(b) Unless otherwise stated, personal information will not be disclosed to third parties, except for the purposes of administering the lottery and the Prize.
(c) By entering the lottery, you consent to:
• (i) inclusion of your personal information on our mailing lists. Your ability to opt out of any mailing lists is detailed in our privacy policy; and
• (ii) our use of your personal information to provide you with marketing, promotional and advertising information about the WCH Foundation.

5.4 General
(a) By entering the Lottery, you acknowledge and agree that if you are judged as the prize winner, the WCH Foundation may:
• (i) use your name; and
• (ii) interview you and take your photo, for the marketing, promotional, publicity and other business purposes of the WCH Foundation, including, without limitation, to display your name, photo and winning entry on the Lottery website or Facebook page. You acknowledge and agree that you will not be entitled to any payment or compensation for such use.
(b) There may be ancillary costs and expenses associated with participating in the Lottery and collecting or using a prize, including obtaining a driver’s licence. These costs and expenses are your sole responsibility and will be borne by you. The WCH Foundation accepts no responsibility for any tax implications that may arise from winning a prize and where appropriate, independent financial advice should be sought.
(c) Notwithstanding that the Lottery may be promoted on social media pages, the operators of those social media platforms are in no way sponsoring, endorsing, administering, or otherwise associated with the lottery. You release those operators from any claims you may have in connection with the lottery.
(d) If there is any event that prevents or hinders the WCH Foundation’s conduct of the lottery, it may, in its discretion and subject to applicable laws, cancel the lottery and recommence it at another time under the same or other conditions.
(e) To the maximum extent permitted by law, you agree to indemnify and hold harmless the WCH Foundation (and its agents, officers and employees) against all losses, proceedings, costs, expenses (including legal fees on a solicitor and own client basis), claims and damages arising from your breach of these terms and conditions, your participation in the lottery and any component of the awarded Prize.
(f) To the maximum extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms which may be implied by statute, custom or the common law are excluded from the lottery and these terms and conditions. If any supply under these terms and conditions is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in these terms and conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that the Australian Consumer Law permits WCH Foundation to limit its liability, then the WCH Foundation’s liability will be limited to:
• (i) in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and
• (ii) in the case of goods, the cost of replacing the goods, supplying equivalent goods, or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
(g) Except where otherwise required by law (or the rules of any applicable licensing authority), the conduct of the lottery and these terms and conditions are governed by the laws of South Australia.
