Women’s & Children’s Hospital Foundation Lottery

The Women’s & Children’s Hospital Foundation Lottery (“Lottery”) is being conducted by the Women’s & Children’s Hospital Foundation Inc (WCH Foundation) ABN: 99682331968 of Locked Bag 5, Adelaide SA 5001. To contact the WCH Foundation please call 1300 001 774 or email [email protected].

These terms and conditions apply to the conduct of the Lottery. By purchasing a ticket in the Lottery you acknowledge that you have read these terms and conditions and that you agree to be bound by these terms and any other terms attached to specific prizes including the terms of redemption. The Lottery is conducted in South Australia under Lottery Licence #M14692.

Proceeds support the work of the Women’s & Children’s Hospital Foundation and improve the health and wellbeing of women, children and families under the care of the Women’s and Children’s Health Network. The WCH Foundation relies upon generous contributions from the community to support the purchase of state-of-the-art medical equipment, deliver our Laklinyeri Beach House Program, provide immediate emergency support to families in need, reduce distress and anxiety of patients through our extensive Arts in Health Program, and invest in vital medical research.

Eligibility

The Lottery is open to all Australian residents that are a minimum of 18 years of age, other than any of the following, who are ineligible to purchase tickets in any capacity:
• any board member, committee member or staff member at the Women’s & Children’s Hospital Foundation;
• any immediate family of any board member, committee member or staff member at Women’s & Children’s Hospital Foundation; or
• any Freerange Future employee;
• any BDO Audit Pty Ltd employee;
• any immediate family of any employee at Freerange Future or BDO Audit Pty Ltd;
• Scrutineer of the Lottery; or
• any other employee, director or officer of any company or agency associated with the Lottery, or their immediate families.

Prizes will be awarded to the person named on the official ticket. Only one prize will be awarded to the first person named on the official ticket, where more than one person’s name appears on the ticket.

An ‘immediate family’ includes but may not be limited to …. spouse, defacto, parent, child or sibling, under applicable law.

How to enter the Lottery

• The competition period commences at 9:00am ACDT on 5 February 2025 and ends at 11:59pm ACST on 5 May 2025 (the “Lottery Period”).
• WCH Foundation reserves the right to amend the Lottery end date, draw date, notification of winner date and publication of winner name date at any time (subject to regulatory approval) by providing reasonable notice to entrants.
• To enter the competition, tickets can be purchased online at www.lotterywchf.org.au by Visa or Mastercard or by phoning our call centre on 1300 001 774. Purchases by credit card or cash, can be made at our offices at 55 King William Road, North Adelaide, 5006. Purchases by cheque will only be eligible for future Draws if they are received, cleared and processed prior to the relevant draw deadline. We do not accept any responsibility for cheques that have not cleared or been processed by the cut-off times for the relevant draws, or any cheques that we do not receive in time for the draw.
• The WCH Foundation accepts no responsibility for:
i. any entries not received for any reason during the Lottery Period;
ii. lost, late or misdirected entries;
iii. unforeseen technical difficulties with the ordering process and does not guarantee the ordering process will always be available.
• The WCH Foundation reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure to enforce any of its rights at any stage does not constitute a waiver of these rights.
• Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.

Prize details

• The total prize pool for the Lottery is valued at approximately AUD $189,857 as at the date of print of these terms.
• The individual prize details are set out below as follows:

  1. VIP Prize Draw
  2. Golden Early Bird Prize Draw
  3. Early Bird Prize Draw
  4. Bonus Prize Draw
  5. First Prize Draw

• A total of 16,500 tickets are available for purchase. A total of 26 prizes are available. A list of all the prizes (including all inclusions and exclusions) is available on our website at www.lotterywchf.org.au/our-prizes. Prizes awarded may not be exactly as illustrated. Tickets are priced at 1 for $40, 3 for $95, 5 for $150, 7 for $200 or 10 for $280. Subject to the total number of tickets available, there is no limit on the number of individual tickets a person may purchase. For the avoidance of any doubt, all tickets purchased from the commencement of the Lottery are returned to the draw for all remaining draws, including the tickets that are successful in winning a prize prior to the First Prize Draw on Wednesday 7 May 2025.

1. VIP Prize Draw
• There will be a total of five winners in the VIP Draw. Each VIP Prize winner will win $1,000 cash.
• Only tickets purchased before 11:59pm on 10 February 2025 are eligible for the VIP Draw. The winner of the VIP Prize winners will remain eligible to win the Golden Early Bird Prize, Early Bird Prize, Bonus Draw and First Prize.

2. Golden Early Bird Prize Draw
• There will be a total of two winners in the Golden Early Bird Draw. Each Golden Early Bird Prize winner will win the choice between Gold Bullion to the value of $5,000 or $5,000 cash.
• Only tickets purchased before 11:59pm on 3 March 2025 are eligible for the Golden Early Bird Draw. The winners of the Golden Early Bird Prize will remain eligible to win the Early Bird Prize, Bonus Draw and First Prize.

3. Early Bird Prize Draw
• There will be a total of three winners in the Early Bird Draw. Each Early Bird Prize winner will win the choice a Phil Hoffmann Travel Voucher to the value of $5,000 or $5,000 cash.
• Only tickets purchased before 11:59pm on 24 March 2025 are eligible for the Early Bird Draw. The winners of the Early Bird Prize will remain eligible to win the Bonus Draw and First Prize.

4. Bonus Prize Draw
• There will be a total of 15 winners in the Bonus Prize Draw. Each Bonus Prize winner will win a $50 Coles Group & Myer voucher.
• Only tickets purchased before 11:59pm on 14 April 2025 are eligible for the Bonus Draw. The winners of the Bonus Draw Prize will remain eligible to win the First Prize.

5. First Prize Draw
• Tickets purchased before 11:59pm on 5 May 2025 are eligible for the First Prize
• Tickets purchased before 11:59pm on 5 May 2025 are eligible for the First Prize.

Prizes General Terms
• All prizes are not transferable, or otherwise substitutable, by the prize winner. No component of a non-cash prize may be redeemed for cash.
• All prizes are subject to availability. If any prize or part of it becomes unavailable due to circumstances beyond the WCH Foundation’s reasonable control, it reserves the right to provide a similar product of equivalent value as the original prize, subject to any applicable laws.
• In relation to the non-cash Early Bird Prize option: The vouchers are valid for 36 months (from date of issue) only. Please contact Phil Hoffmann Travel on 8350 5700 to redeem your voucher. Travel is subject to availability at time of booking (and conditions will apply). Extensions, alterations, and upgrades are subject to availability and at winner’s own expense. Vouchers are not transferable or redeemable for cash, traveller’s cheques, foreign currency, or other credit. Bookings are subject to Phil Hoffmann Travel Schedule of Professionalism. Prize winners will be subject to those terms and conditions and the WCH Foundation accepts no responsibility for compliance with, or enforcement of, those terms and conditions. Upon issue to the prize winners, the vouchers will not be replaced by the WCH Foundation in any circumstances (including if lost, destroyed or stolen).
• In relation to the non-cash First Prize option: the recommended retail price includes cost of delivery to locations in metropolitan Adelaide, stamp duties, 12 months Compulsory Third Party and registration. The actual vehicle may vary from the image, which is used for illustrative purposes only. The estimated delivery date is approximately 6 months after the prize is claimed but may be subject to change. For the Toyota LandCruiser 300 VX the prize offered is the Landcruiser Wagon VX 3.3L Diesel Automatic. Any upgrades or extras are to be discussed directly with CMI Toyota and will be at the winners own expense. Colours, features and options are subject to change. If the winner selects the Toyota LandCruiser 300 VX plus $30,000 as a prize, they must have an appropriately licensed driver collect the vehicle from CMI Toyota.

Selection of winner – Draws
• The VIP Prizes will be drawn from 10:00am on 12 February 2025.
• The Golden Early Bird Prizes will be drawn from 10:00am 5 March 2025.
• The Early Bird Prizes will be drawn from 10:00am on 26 March 2025.
• The Bonus Draw Prize will be drawn from 10:00am on 16 April 2025.
• The First Prize will be drawn from 10:00am on 7 May 2025.

All draws will occur at the offices of the WCH Foundation: Ground Floor, 55 King William Road, North Adelaide, SA 5006. All draws will be determined by lot (using random number generator software developed for the purposes of assisting the conduct of lotteries).

All draws will occur:
• under the supervision of the WCH Foundation;
• in the presence of an independent scrutineer who is not associated with the WCH Foundation or otherwise involved in the conduct of the lottery; and
• in the presence of any ticket holders who wish to be present.

WINNER NOTIFICATION AND COLLECTION OF PRIZES

Notification
All winners will be contacted via telephone and email from the WCH Foundation within 7 days of each draw with information on how they may collect their prize.

Publication
Each winner consents to us publishing the winner’s name and suburb unless the winner has expressly opted to remain anonymous at the point of purchase.
The prize winner’s name will be published:
• on the Lottery website no later than 24 hours after the prize is drawn;
• in an electronic direct mail blast to those who purchased a ticket in the Lottery no later than 24 hours after the prize is drawn; and
• on the Lottery Facebook page and Instagram page no later than 24 hours after the prize is drawn.

Claiming Prizes and Unclaimed Prizes
• It is the responsibility of the prize winner to claim their prize. Prizes will be awarded to the first person named on the official ticket. Prize winners will be required to provide 100 points of identification, as a condition of prize collection occurring.
• Each draw winner will have one calendar month from their draw date to claim their prize.
• If any of the prize winners do not collect their prize during this one calendar-month period, they will be deemed to have forfeited any right to their prize, and in conversation with the Office of Consumer and Business Services, the WCH Foundation will redraw the prize.

Second Chance Redraws
If a second chance redraw is needed the redraws will take place at the following times:
• The VIP Prize will be redrawn from 10:00am on 12 March 2025.
• The Golden Early Bird Prize will be redrawn from 10:00am on 2 April 2025.
• The Early Bird Prize will be redrawn from 10:00am on 23 April 2025.
• The Bonus Prize will be redrawn from 10:00am on 14 May 2025.
• The First Prize will be redrawn from 10:00am on 4 June 2025.


• All redraws will occur at the offices of the WCH Foundation: Ground Floor, 55 King William Road, North Adelaide, SA 5006 in the presence of a scrutineer.
• All redraw winners will be contacted via telephone and email from the WCH Foundation within 7 days of each second chance draw with information on how they may collect their prize.
• The results of any second chance draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.
• If a second chance winner prize winner does not accept the prize within 1 month of being notified that they have won the prize/s, is not readily identified and reasonable efforts have been made by WCH Foundation to identify the winner were unsuccessful, they will automatically forfeit their prize/s and WCH Foundation reserves the right to donate the prize/s.


All redrawn winners will be published:
• on the Lottery website no later than 24 hours after the prize is drawn;
• in an electronic direct mail blast to those who purchased a ticket in the Lottery no later than 24 hours after the prize is drawn; and
• on the Lottery Facebook page and Instagram page no later than 24 hours after the prize is drawn.

General Lottery Terms

Prize Values
The value of the prizes at the time of redemption may be different from their stated value in these terms and at www.lotterywchf.org.au. The winner is not
entitled to the difference, if any, between the stated value of the prize and the actual value of the prize at the time of redemption.

Refunds
Requests for Refunds can only be made if the corresponding ticket has not been included in any prize draws. If a refund is requested during standard business hours (Monday – Friday, 9am-5pm, ACST) your refund will be processed by WCH Foundation within 48 hours. For all requests outside these hours, your refund will be processed within the next two business days. Refunds will not be accepted on or after 7 May 2025. Upon processing a refund, the corresponding ticket(s) will become void. Refunds can only be requested by calling 1300 001 774 or emailing [email protected].

Privacy
Your personal information (“PI”) will be collected by WCH Foundation in connection with this lottery and:
• used to administer the lottery, enable the identification of the prize winner and to provide you with marketing, promotional and advertising information about WCH Foundation; and
• handled in accordance with WCH Foundation’s privacy policy located at wchfoundation.org.au/privacy/. The Privacy Policy also contains information about how you may access, update or correct your PI, how you may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
• If you do not provide (or WCH Foundation cannot otherwise collect) all of the PI requested, you will not be eligible to receive the prize/s. Submitting an entry is also conditional on providing this PI.
• Unless otherwise stated, personal information will not be disclosed to third parties, except for the purposes of administering the lottery and the Prize.


By entering the Lottery, you consent to:
• inclusion of your personal information on our mailing lists to send you information about our products and services. Your ability to opt out of any mailing lists is detailed in our privacy policy;
• our use of your personal information to provide you with marketing, promotional and advertising information about WCH Foundation; and
• being contacted if you are drawn as a prize winner for using your name; interviewing you and taking your photo, for the marketing, promotional, publicity and other business purposes of WCH Foundation, including, without limitation, to display your name, photo and winning entry on the Lottery website or Facebook page. You acknowledge and agree that you will not be entitled to any payment or compensation for such use.

Standard Terms
You acknowledge and agree that if you are drawn as the prize winner, there may be trivial costs associated with participating in the Lottery and collecting a prize. These trivial costs are your sole responsibility and will be borne by the winners. The WCH Foundation accepts no responsibility for any tax implications that may arise from winning a prize and where appropriate, independent financial advice should be sought.
• If there is any event that prevents or hinders or otherwise interferes with WCH Foundation’s conduct of the Lottery, including but not limited to technical difficulties, unauthorised intervention or fraud, it may, in its sole discretion and subject to applicable laws, modify, suspend, terminate or cancel the Lottery and recommence it at another time under the same or other conditions, and disqualify any individual.
• To the maximum extent permitted by law, you agree to indemnify and hold harmless WCH Foundation (including but not limited to its agents, officers and employees) against all losses, proceedings, costs, expenses (including legal fees on a solicitor and own client basis), claims and damages arising from your breach of these terms and conditions, your participation in the lottery and any component of the awarded prize.
• To the maximum extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms which may be implied by statute, custom or the common law are excluded from the lottery and these terms and conditions. If any supply under these terms and conditions is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in these terms and conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that the Australian Consumer Law permits WCH Foundation to limit its liability, then WCH Foundation’s liability will be limited to:
• in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and
• in the case of goods, the cost of replacing the goods, supplying equivalent goods, or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
• For the avoidance of doubt, WCH Foundation (including its respective officers, employees and agents) is not responsible for and excludes all liability for indirect or consequential loss or damage that you may suffer in connection with this Lottery including loss of opportunity, loss of profit, personal injury or property damage, or similar.

Except where otherwise required by law (or the rules of any applicable licensing authority), the conduct of the lottery and these terms and conditions are governed by the laws of South Australia.
